Representing: herself and other disabled Maori
Concerning: the failure of the Crown to provide for the healthcare of Maori in respect of the delivery and outcomes experienced by Maori disabled. The claimant alleges that the Crown has breached the principles of the Treaty of Waitangi by failing to: • Recognise Maori disabled as a group; • Ensure all health and disability services and supports encompass the needs of Maori disabled and their whanau in a timely and culturally appropriate manner under tikanga; • Provide adequate forms of support to ensure Maori with disabilities can participate equitably with non-Maori with disabilities at all levels of decision making, including properly implementing the New Zealand Disability Strategy; • Adequately provide reasonable consultation with Maori disabled to ensure they have adequate access to services and supports in the health and disability sector in a culturally appropriate manner under tikanga; • Assist Maori disabled into higher education and employment, and protect them from experiencing homeless ness; • Protect Maori disabled from discrimination, abuse and violence from service providers and from the rationing of health services; • Record and monitor the reasons for the growing disparity in provisions made for Maori disabled; • Educate Maori iwi, hapO and whanau about disability and how to support whanau with disabilities; and • Allow Maori disabled representation and participation at the United Nations international indigenous disability meetings, the indigenous disability forums, Convention on the Rights of Persons with Disabilities (UNCRPD) and Declaration on the Rights of Indigenous People (UNDRIP) meetings.
