Concerning:The claim concerns institutional and interpersonal racism within New Zealand and how that racism has negatively affected the health of Māori in respect of cancer. The claimant alleges that the Crown: • Does not provide Māori with the opportunity to have adequate input into health policy and practices which effect them; • Gives Māori public health a low priority and visibility in core policy documents; • Takes into account evidence which is not appropriate for Māori in designing health policy; • Employs policy makers and senior managers who have no professional requirement or obligation to have cultural or political competency; • Lacks the ability to effectively assess Māori needs and aspirations, and has limited internal consultation processes; • Designed and implemented health interventions and policies that fail to take into account the health effects of racism; and • Has, through institutionalised and interpersonal racism, failed to provide equal access to health care for Māori in respect of cancer.

Concerning: The claim concerns the failure of the Crown to provide for the healthcare of Māori in relation to cancer. The claimant alleges that the Crown has breached the principles of the Treaty of Waitangi by failing to: • Take protective action to address group disparity where Māori suffer significantly poorer health than non-Māori; • Allocate health resources for remedial purposes, specifically for Māori benefit, or to assist an at-risk group of which Māori constitutes a high proportion; • Use promotional means of information and advocacy, such as health education aimed at changing lifestyle habits; • Provide additional resources specifically devoted to Māori communities whenever general provision of services is not giving sufficient protection; • Provide equal standards of healthcare to Māori as to non-Māori; • Ensure a general equality of health outcomes for Māori as a whole compared to non-Māori, as a benefit of the citizenship granted by the Treaty; • Act in good faith and to consult with Māori in relation to health services; and • Provide sufficient resources and funding towards the health and wellbeing of Māori.

Concerning:The claim concerns the failure of the Crown to provide adequate healthcare to Māori in respect of gout. The claimant alleges that the Crown has breached the principles of the Treaty of Waitangi by failing to: • Adequately address Māori suffering gout at epidemic levels; • Provide adequate, appropriate and timely health for Māori in respect of gout; • Encourage Māori to seek professional medical advice regarding their gout problems; • Ensure that Māori receive proper care, medication and treatment they require to effectively address gout; and • Ensure that Māori are fully educated in respect of health issues including the causes of gout and the best means of addressing it.
