Representing: Nicky Stevens, her whanau, Ngai Tahu and all Maori suffering from mental illness
Concerning: The claim concerns the failure of the Crown to provide for the healthcare of Māori in respect of mental illness. The claimant alleges that the Crown has breached the principles of the Treaty of Waitangi by failing to: • Deliver adequate mental health services to Māori; • Consult Māori over the delivery of health services for Māori; • Adequately ensure that health policy is kept up to date with regard to self-harm, suicide and Māori mental health policy; • Address funding and staffing needs to improve Māori mental health services; • Protect the provision of kaupapa Māori mental health services; • Allow Māori tino rangatiratanga over their kaupapa, by the Crown assuming control over mental health policy; • Provide adequate funding for Māori health initiatives or tikanga-based treatment within the wider health service; • Protect kaupapa Māori through its application of the Crown’s health policy; • Protect Māori from poverty, sickness, high mortality and economic marginalisation; and • Resource Māori with the ability to provide for the health issues of Māori.

Concerning: The claimant alleges that the Crown has breached the principles of the Treaty of Waitangi by failing to: • Adequately investigate the extent of impairment and disabilities affecting Māori; • Adequately address the needs of impaired and disabled Māori, including actively assisting them to improve their quality of life and providing sufficient resources and support for the whānau of disabled Māori to empower them to adequately care for their whānau; • Provide timely and adequate healthcare and support for Māori living with disabilities, especially for those Māori living who live rurally; and • Provide sufficient funding for rural Māori living with disabilities to enable them to live a full life.
