The claimant alleges that the Crown has breached the principles of the Treaty of Waitangi by failing to: • Regulate the Gambling Act 2003, Local Government Act 2002, Racing Act 2003 and treatment related to harmful gambling; • Engage with Māori in the development of the Gambling Act 2003; • Identify and fully inform Māori of the social impact of Class 4 gambling; • Ensure local councils are appropriately engaging with Māori when reviewing the gambling policies; • Support Māori affected by family violence which has been caused by harmful gambling; • Ensure community funding is distributed in a manner that is fair and equitable to Māori; and • Ensure that gambling harm minimisation is not at the expense of hauora, wairua, tinana and hinengaro of Māori or any person using Class 4 Gambling Machines.

The claimant alleges that the Crown has breached the principles of the Treaty of Waitangi by: • Giving Māori health a low priority and visibility within core policy documents; • Allowing Crown officials to use a process to filter the evidence that informs Crown policy that consistently minimises the input of Māori; • Employing Crown policy makers and senior managers who have no professional requirement or obligation to have cultural or political competency; • Failing to address and implement any key recommendations from landmark Māori health hui; • Designing and implementing health intervention and policies that fail to take into account the health effects of racism; and • Failing to adequately address the methamphetamine (P) epidemic, and therefore failing Māori because Māori a more likely to use methamphetamine than non-Māori.
